MUSIC PRODIGY PRIVACY POLICY

The Way of H, Inc. ("TWH") dba ‘Music Prodigy' values your privacy. This Privacy Policy describes how we protect your privacy and, in particular, your personal information. Personal information is data that can be used to uniquely identify or contact a single person. Please take a moment to review our policy and let us know if you have any questions about it. When the words Music Prodigy, or "we" or "us" are used in this privacy policy, they refer to TWH.

If you are under the age of thirteen (13) please read this! If you are under the age of thirteen (13) you may not register for this website or license this software unless:

  1. Your parents or guardian first writes to us via email and gives us both their contact information (name and email address) and your contact information (name and email address) and specifically approves your registering for this website and gives us permission to contact you for technical support.

If you are enrolled through a school or at the instruction of a school, we may also send the school information on your performance and may also send it to your parent or guardian.

FOR USERS WHO ARE THIRTEEN (13) YEARS OF AGE OR OLDER OR WHO HAVE BEEN PERMITTED BY A PARENT, GUARDIAN OR SCHOOL TO USE THIS WEBSITE EVEN IF UNDER THE AGE OF THIRTEEN (13)

If you enroll on this website (please see above for information as to who is permitted to enroll), you can practice music, review your performance, interact with music, and submit assignments to your music teacher. The website will automatically allow your music teacher to issue and manage assignments and contact you for purposes of your music class. This privacy policy describes how we handle information about you that is generated by your registration for the website and your use of the website.

If you are thirteen (13) or older and you desire to license Music Prodigy or any other related Music Prodigy products, we ask you to register by giving us a valid, personal email address, providing your first and last name and choosing a user name and password. That is the only information we ask you to provide us. If you then subsequently opt to license additional material, we will ask you for your previously entered user name and/or email address and password in order to identify you. If you choose to use our website, www.Musicprodigy.com, we may also ask you for some or all of your information in order to validate your identity.

We urge you not to use your real name for either user name or password, and we urge you not to share your user name, password, or email with anyone, since even one item of that that information may allow people to attempt to impersonate you.

Your email address is information that uniquely identifies you, and, unless you opt in to receiving emails from us (see Opt-In, below), we will use it only to contact you in the event you contact us first. We will not contact you if we do not have reason to believe that you are under the age of 13 and have permission from your parent, guardian or school for us to contact you. . If we have reason to believe you are under the age of thirteen (13), we will close your account unless we have received written permission from your parent, guardian or school as provided in the first paragraphs of this Privacy Policy. An exception to this policy is that if we have reason to believe that someone is attempting to use your account improperly (for example, by multiple, failed attempts to enter a user name or password), we may contact you by email to alert you to the problem and/or alert you by email that we have frozen your account until you assist us to correct the problem, by entering a new user name, email address and/or new password or taking other protective measures. We may also use your email address to send you other important messages of a non-commercial nature, including administrative notifications. Update notices may include such items as bug fixes, changes to features, song lists, artwork and lessons, revised opt-in provisions, availability of Music Prodigy for download in additional countries and changes to the Music Prodigy End User License Agreement, Terms of Use and Service or Privacy Policy. You may elect not to receive further administrative notifications of this type by clicking "unsubscribe" on our website. Please allow up to ten days to be removed from the administrative notification list. Clicking "unsubscribe" will not prevent us from sending you critical notifications, including changes to the End User License Agreement, Terms of Use and Service, Privacy Policy, critical bug fixes, notification that your account has been frozen, notification that you need to create a new password or take other protective measures, as well as other security-related or function-related information we believe is critical for you to receive.

Opt-in Options

When you first license any Music Prodigy product or related content and we first ask you to register by giving us a valid, personal email address, first name, last name and choosing a user name and password, we will also present you with an "opt-in" option by which you may request us to send you emails of various types, including emails from Music Prodigy itself such as information about new songs, features, lessons, products and other news or information about Music Prodigy and/or emails concerning products and services offered by our business or promotional partners or affiliates. You may not opt-in to this feature if you are under the age of thirteen (13). If you are over the age of thirteen and choose to opt-in, you may later unsubscribe by clicking unsubscribe on our website. Please allow up to ten days to be removed from the opt-in list. Clicking "unsubscribe" will not prevent us from sending you critical notifications, including changes to the End User License Agreement, Terms of Use and Service, Privacy Policy, critical bug fixes, notification that your account has been frozen, notification that you need to create a new password or take other protective measures, as well as other security-related or function-related information we believe is critical for you to receive.

You may also choose to opt-in by sending us an email at the email address at the end of this Privacy Policy. Please allow up to ten days after your email is sent for your opt-in to be effective.

Restrictions on Sharing Your Personal Information with Third Party Vendors

At times we use third party vendors to process requests by you for information or otherwise to service your account. In those cases, the third party vendors are bound by contract to respect your privacy and not to disclose or improperly use your email address or any other personally identifying information you might send to us, even if we did not request you to send it.

We will not otherwise share your email address or other personally identifying information with third party vendors, and we will not send you unsolicited emails or information unless you are thirteen years of age or older and opt-in on our website.

Additional Information We May Collect About You or Your Use of Music Prodigy

If you register, we may use cookies and other technologies to "remember" you or otherwise facilitate your use of our services.

We may at times collect information about how you use Music Prodigy, including your activities with Music Prodigy features on our website—for example, what you click on, how much time you spend with various features, and what songs, lessons, features and other products you download. We use this information, aggregated with the data of other users, to improve our services and products—for example, to determine what additional songs or features to make available to users. TWH may also gather other, non-personally identifiable usage statistics. TWH may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you, and we may share anonymous aggregated data with our third party service providers, including advertisers.

If you participate in online services, such as social networks to which you upload or download comments about Music Prodigy or ask Music Prodigy to post information concerning you, such as your musical Performance Results (including scores, rankings and achievements) — see Music Prodigy Terms of Use and Service for more details on Performance Results—TWH may collect, store, use, transmit and publicly display statistical data regarding such content and postings and may also share it with TWH's third party providers.

In order to facilitate these processes, we may use cookies and other technology, including pixel tags and web beacons.

You may disable cookies by consulting your internet service provider. If you are using a mobile device and are using Safari, go to Safari, then to Settings and then to the Cookies section. You should be aware that if you disable cookies, you may render certain aspects or areas of the Music Prodigy website inaccessible to you.

As is true of many websites, we also automatically gather some information and store it in log files. This information includes Internet Protocol (IP) addresses, browser type and language, Internet Service provider (ISP), referring and exit pages, operating system, date/time stamp, clickstream data, and the type of device you are using. We may use this information to validate your identity, and, aggregated with the data of other users, in our marketing and advertising, including advertising or marketing directed to you if you in to receive such information directly. We treat information collected by cookies and other technologies as non-personal information. However, to the extent that Internet Protocol (IP) addresses are considered by local law as personal information, we also treat those identifiers as personal information.

The Music Prodigy website may contain links to third party websites, products and services. Those websites, products and services are governed by their own end user license agreements, terms of service and privacy policies. We urge you to learn about and familiarize yourself with third party agreements of those sites you choose to link to, including their privacy agreements.

Legal Compliance

It may be necessary, in order to comply with law, legal process, litigation and/or requests from public and governmental authorities within or outside the United States, to disclose your personal information. We may also disclose information about if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate. We may also disclose your personal information to Apple or Google upon request by Apple or Google if it relates to Apple's or Google's concerns regarding the proper or legal use of the App, the App Store or other Apple services or products or the Android Store or other Google products. Please also note that when you use the App Store or Android store, Apple or Google may gather information about you based on its own Privacy Policy.

We do not knowingly collect personal information from children under the age of thirteen (13). If we learn that we have collected the personal information of a child under the age of thirteen (13) without the permission of the child's parent, guardian or school, we will take steps to delete the information as soon as possible.

Please also note that, as stated in both the Music Prodigy End User License Agreement and the Music Prodigy Terms of Use and Service, Music Prodigy is intended only for people above the age of thirteen (13). If you are between the ages of thirteen (13) and eighteen (18) you should consult a parent or guardian concerning the appropriateness for you of the application before downloading it and should ask a parent or guardian to review this Privacy Policy, as well as the Music Prodigy End User License Agreement and the Music Prodigy Terms of Use and Service, which may be found at http://www.Musicprodigy.com/terms-of-service.

Our Commitment to Your Privacy

To make sure your personal information is secure, we communicate our privacy and security guidelines to Music Prodigy employees and contractors and strictly enforce privacy guidelines throughout the company. We also use various security measures to protect your privacy. We will retain your personal information for as long as we believe we need it or for the maximum period permitted by law, whichever is longer.

Inquiries sent by email are likely to be responded to more promptly than inquiries received by mail or phone. If you write to us in Spanish, it may take us somewhat longer to respond than if your communication is in English. We may use Google Translate both to read your communication and to respond. We apologize if that causes our response to be delayed or to use less than flawless grammar, syntax or word choice. We regret that, at this time, we are unable to respond to inquiries or comments written in any language other than English, or Spanish. We hope in the future to be able to add other languages and other download countries.

Music Prodigy may update its Privacy Policy from time to time. When we change the policy in a material way, a notice will be posted on our website along with the updated Privacy Policy.
